JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-02-2023 This criminal revision application has been filed against order dated 23.08.2016 passed by learned Principal Judge, Family Court, Purnea in Maintenance Case No. 25 of 2012 whereby and whereunder the learned Principal Judge has allowed the petition filed by opposite party no. 2 and directed the petitioner to pay Rs. 5,000/- (five thousand) per month to opposite party no. 2, who is wife of petitioner and Rs. 2,000/- (two thousand) per month to opposite party no. 3, who is daughter of petitioner, as maintenance, with effect from the date of filing of the application on 10th day of every month. It is contended by learned counsel for the petitioner

Patna High Court CR. REV. No.1145 of 2016(5) dt.17-02-2023 2/2 that petitioner is working in a Bidi company and earns Rs. 100/- per day and has no other source of income and as such, he is unable to pay the maintenance amount, as directed by the Court below.

Having gone through the impugned order, I do not find any illegality or perversity to interfere with the same. The amount of maintenance fixed by the Court below cannot said to be excessive.

Accordingly, in the background of the facts and circumstances, as mentioned in the impugned order, this criminal revision application stands dismissed. (Prabhat Kumar Singh, J) anay/- U T
