The petitioner seeks bail in a case registered for offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(A)(B) (C) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 26 liters country made liquor were recovered from a tempo on which the co-accused including the petitioner were boarding. Petitioner claims his antecedent to be clean and he is in custody since 22.03.2017.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail
Patna High Court Cr.Misc. No.33699 of 2017() dt.20-07-2017 2/2 on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Town Motihari P.S. Case No.182 of 2017. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bond.
