The petitioner is in custody in connection with Mehdiganj P.S. Case No. 02 of 2017 for the offences under Sections 293, 294, 354, 436, 385 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is unexplained delay of 11 days in filing the FIR and the case of the petitioner is similar to that of co-accused Santosh Kewat @ Santosh Kumar Sahani who has been granted bail by this Court on 1.7.2017 in Cr. Misc. No. 27263 of 2017..

On the ground of parity, I am inclined to grant bail to

Patna High Court Cr.Misc. No.27430 of 2017 (2) dt.06-07-2017 2/2 the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Patna City or the successor Court in connection with Mehdiganj P.S. Case No. 2 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
