====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date : 30-09-2019 Heard learned counsel for the petitioner and learned AC to AAG 13 for the State.

2. Pursuant to order dated 03.09.2019, the Administrator, Bihar State Agriculture Marketing Board (since dissolved) is present and has filed show cause.

3. From the same it transpires that the exercise, as was required to be completed in terms of the order dated 26.04.2018 passed in CWJC No. 11952 of 1998, has been complied with as far as the petitioner is concerned and subsequent to the post being upgraded, pay scale has also been enhanced as far as the petitioner

Patna High Court MJC No.3523 of 2018 dt.30-09-2019 2/2 is concerned and whatever financial benefit has accrued to him has been calculated and cheque for an amount of Rs. 62,824/- has been brought to the Court which has been handed over to learned counsel for the petitioner.

4. Learned counsel for the petitioner accepts it without prejudice to his rights and claim.

5. In view thereof, the application stands disposed off.

6. However, it shall be open to the petitioner to represent before the officer present in Court with regard to any discrepancy relating to calculation pursuant to the upgradation of the post and enhancement of his salary. If the same is filed, the officer concerned shall get the same verified from the official records and pass a reasoned order.

7. Personal appearance of the officer stands dispensed with.
