2. Petitioner seeks bail who is in custody since 27.04.2022 in connection with Special Case No. 182 of 2021 arising out of NCB Case No. 27 of 2021, F.I.R. dated 20.11.2021 for the offences punishable under Sections 8(C) read with Section 20(b) (ii) (C) 25, 35 and 29 of the NDPS Act, 1985.
3. Earlier the regular bail application of the petitioner has been rejected thrice by this Court vide order dated 23.02.2023, 23.02.2024 and 24.01.2025 passed in Cr. Misc. No. 51123 of 2022, Cr. Misc. No. 5909 of 2024 and Cr. Misc. No. 83219 of 2024

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that as per the F.I.R, altogether 311.600 kg Ganja has been recovered from the truck in question. He further submits that the petitioner is in custody since 27.04.2022 and the trial has not been concluded as yet. The similarly situated co-accused, namely, Adalat Rai has been granted regular bail by this Court vide order dated 04.07.2025 and another co-accused, namely, Mukesh Kumar has been granted regualr bail by a Co-ordinate Bench of this Court vide order dated 10.10.2025 passed in Cr. Misc. No. 46726 of 2025.
5. Learned Additional Public Prosecutor as well as learned counsel for the Union of India have vehemently opposed the prayer for bail of the petitioner on the ground that the petitioner carries one criminal antecedent other than the present one.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Speical Judge (NDPS Act) Court No. 1, Patna in connection with Special Case No. 182 of 2021 arising out of NCB Case No. 27 of 2021,

Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below. ii. If the petitioner tampers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
iii. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
