JUSTICE SHAILENDRA SINGH ORAL ORDER 23-09-2025 The instant writ application has been filed by the petitioner under Article 226 of the Constitution of India, seeking the following reliefs :- "(i) For direction to the respondent authorities to pay the cost of the personal land acquired by authorities to construct a road.

(ii) For direction to the respondent authorities to provide a Government job to a family member of petitioner as earlier provided to other persons is lieu of land acquirement.

(iii) For directing all the respondents to provide all consequential benefits to the petitioner as per law.

(iv) For directing the respondents to pay the cost of the case.

2. Heard Mr. Nawal Kishore Singh, learned counsel for the petitioner and Mr. Madhukar Mishra, learned AC to SC16 for the State-respondents.

The main grievance of the petitioner raised in this petition is that the petitioner's 12.5 dhur land has been used for construction of the village road without acquiring the land and without giving compensation to petitioner's family for the said land. It is submitted by petitioner's counsel that though the land in question was used for construction of road several years back i.e. in the year 1997-98, but at that time no steps were taken by the petitioner's family for raising an issue with regard to getting compensation as the petitioner's father had died in the year 1981 and thereafter, the petitioner's widow mother could not protest due to her poverty and at that time, the petitioner was also a minor and after attaining majority and becoming aware of the aforesaid issue, the petitioner filed a representation before the District Land Acquisition Officer, Hajipur (respondent No. 4) (Annexure- 'P/4' series), for redressing his grievance. It is further submitted by petitioner's counsel that on the application of the petitioner, the land in question has been measured by the

Patna High Court CWJC No.15027 of 2025(2) dt.23-09-2025 3/3 concerned revenue authorities and it has been found that the petitioner's land has been used in the construction of the village road and in this regard, specific averments have been made in the petition.

Considering the aforesaid submissions and having gone through the averments made in this petition, the District Land Acquisition Officer, Hajipur (respondent No. 4), is hereby directed to look into the petitioner's matter detailed in Annexure- 'P/4' series, which has been filed before him and take necessary steps as per the provisions of law to redress the petitioner's issue if he has made out a bonafide issue in his application, within three months from the date of receipt of a copy of this Court's order or production of the same.

5. Accordingly, with the above direction, the instant civil writ petition stands disposed of.
