JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-09-2017 Heard learned counsel for the petitioner, State and the counsel appearing on behalf of the informant. Petitioner is an accused in Ara Town P.S. Case No. 601 of 2016 for an offence under section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Senior counsel, Mr. Y.C. Verma appearing on behalf of the petitioner has drawn my attention to the fact that out of four co-accused, three have been granted bail including Shyam Nandan Singh against who similar allegation have been levelled. Counsel for the opposite party submits that Shyam Nandan Singh was granted bail on consideration of the fact that he has remained in custody for one year. He admits the fact that in

Patna High Court Cr.Misc. No.44035 of 2017 (2) dt.19-09-2017 2/2 the instant case investigation is now completed and police has already submitted charge-sheet.

In view of the fact that similarly circumstances not only Shyam Nandan Singh but two other co-accused in a case relating to dispute of 'Nala' have been granted bail by this court in Cr. Misc. No. 23595 of 2017 and Cr. Misc. No. 26754 of 2017 vide order dated 18.5.2017 and 21.8.2017 and also co-accused Shyam Nandan Singh was granted bail in Cr. Misc. No. 29195 of 2017 vide order dated 21.8.2017 on the ground of parity, I am inclined to enlarge the petitioner named above on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 601 of 2016 on the condition that the petitioner will cooperate in the trial and will not, in any manner, influence the evidence or the witnesses.
