This application is for grant of regular bail in connection with Chanpatiya P.S.Case No.116 of 2017, for the offences punishable under Sections 20, 22 and 23 of the N.D.P.S. Act.

There is recovery of 90 gram of brown sugar from the possession of the petitioner.

Submission of the learned counsel for the petitioner is that there is violation of Section 50 of the N.D.P.S. Act while making seizure and further submission is that he is in custody for about three months and the seized articles are below the commercial quantity.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.33438 of 2017 (2) dt.21-07-2017 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months and if not concluded, the petitioner is at liberty to renew his prayer for bail bond before the court concerned. With the aforesaid observation, this application is dismissed.
