The petitioner seeks bail in a case registered under Section 370 of the Indian Penal Code and 3/4/7 of Immoral Traffic (Prevention) Act and 9/16 of Prohibition of Drugs and Cosmetic Act.

Allegation is that on secret information the informant raided Yatri Niwas, Rest House of the petitioner and caught some gents and ladies in objectionable condition. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.06.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is

Patna High Court CR. MISC. No.59941 of 2019(2) dt.25-09-2019 2/2 alleged to be the owner of the premises in question, where brothel is alleged to have been running. It is further submitted that the premises in question does not belong to the petitioner nor he is the employee of the said Yatri Niwas. He has been made accused due to mistake of fact. He has got no concern with the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in connection with Darbhanga Sadar P.S. case No.249 of 2019.
