The petitioners seek bail in Gaighat P.S. Case No. 374 of 2021, registered for the offence punishable punishable under Sections 272, 273 and other allied sections of the Indian Penal Code and section 30(a), 36 and 41(1) of the Bihar Prohibition and Excise Act, 2018.
190.95 litres of foreign liquor has been recovered from Scorpio and petitioners were travelling in the said vehicle. It is submitted that no recovery has been made from conscious possession of petitioners and have got no concern
Patna High Court CR. MISC. No.71902 of 2021(2) dt.10-03-2022 2/2 with the seized liquor. Petitioners claim clean antecedent and they are in custody since 16.10.2021. Investigation is complete. Considering the period of custody coupled with the fact that petitioners bear clean antecedent, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Muzaffarpur in connection with Gaighat P.S. Case No. 374 of 2021.
