====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 06-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Vikram P.S. Case No. 61 of 2023 dated 05.02.2023 registered for the offence punishable under Section 379 of the Indian Penal Code.

3. As per the prosecution case, four unknown miscreants are alleged to have stolen the Motorcycle of the informant from the vegetable market.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has three criminal antecedent, as stated in paragraph no. 3 of the bail petition. The petitioner is not

His name has sprang up in the present case on the basis of the confessional statement of the co-accused Ravi Bhushan. Nothing has been recovered from the conscious possession of the petitioner. No T.I. Parade has been conducted, hence, the implication of the petitioner casts doubtful in the present case. He is in custody in this case since 18.05.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Danapur, in connection with Vikram P.S. Case No. 61 of 2023.

7. The application stands allowed.
