Learned counsel appearing on behalf of the petitioners seeks modification of order dated 23.08.2023 passed in Criminal Miscellaneous No. 54764 of 2023 to the extent that due to typographical mistake in the cause title of the bail application, incorrect name of petitioner no. 5 was typed as Amit Kumar in place of Anil Kumar, as would appear from the FIR dated 21.06.2022 arising out of Sherghati (Dobhi O.P.) P.S. Case No. 514 of 2022.

Learned counsel appearing on behalf of the petitioners submits that petitioner no. 5 may not suffer due to latches on the part of his office and seeks for modification of order to the extent that in the cause title of the bail application, correct name of the petitioner no. 5, namely, Anil Kumar may be substituted.
4. Considering the statement made in the modification application, as well as, affidavit duly sworn by the typist, who has admitted that due to typographical mistake, incorrect name of the petitioner no. 5 has been types as Amit Kumar in place of Anil Kumar, the order dated 23.08.2023 passed in Criminal Miscellaneous No. 54764 of 2023 is modified to the extent that correct name of the petitioner no. 5 namely, Anil Kumar be substituted in place of Amit Kumar. The other part of the order
Patna High Court CR. MISC. No.64836 of 2023(4) dt.02-02-2024 3/3 shall remain intact.
5. Accordingly, the present modification application is disposed of.
