1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of regular bail in connection with Turkauliya P.S. Case no.1191 of 2022 registered under sections 308, 147, 341, 323, 324, 325, 504 and 506 of the Indian Penal Code.
3. As per the prosecution case, the accused persons including the two petitioners herein are said to have come variously armed. They are said to have abused the informant and the petitioner no.1 is said to have assaulted the informant with a kudal on his head. On saving himself the informant sustained injuries on his hand. The petitioner no.2 is said to have assaulted the informant with a farsa on his head.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. The petitioner no.1 and the informant are full brothers and the cause of dispute is other than what has been narrated in the F.I.R. The injuries attributable to petitioner no.2 have been found to be simple in nature while the injury no.3 on the forearm though grievous but is on a non vital part of the body. The petitioners are in custody since 22.7.2023 and have no criminal antecedent.
5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the contents of the injury report, the petitioners being in custody since 22.7.2023 and not having any criminal antecedent, the Court directs both the petitioners to be enlarged on bail in connection with Turkauliya P.S. Case no.1191 of 2022 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari.
