JUSTICE SHIVAJI PANDEY ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Chakari P.S.Case No. 113 of 2014 registered u/s 25(1-B)A/26/35 of the Arms Act, 414, 120B IPC and 16, 17, 18, 19, 20 and 21 of the Unlawful Act.
In this case, counsel for the petitioner submits, earlier wrong submission that four pistols were recovered from the possession of petitioner was the cause of rejection of his prayer for bail. To-day he has drawn attention of this Court to the seizure-list with respect to the present petitioner showing recovery of one country-made pistol. Petitioner has been in custody for one year, having no criminal antecedents.
Looking to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.52579 of 2015 (2) dt.16-12-2015 2/2 petitioner Mantu Yadav @ Manoj Yadav is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Jamui in connection with UAP Case No.6 of 2015, arising out of Chakai P.S.Case No. 113 of2014, subject to the conditions that :
(i) one of the bailors will either father, or mother or son of the petitioner, (ii) if the petitioner would be found involved in similar type of case in future, prosecution will be at liberty to file application for cancellation of bail and the court below will pass necessary order, including cancellation of bail bonds, and (iii) the petitioner would co-operate and if the petitioner will fail to co-operate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
