2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act in registered in connection with Sadar Excise P.S.Case No.181 of 2024.
3. Allegedly, 180 litres of illicit wine was recovered from a litchi orchard. On query from the people in the neighborhood, they replied that the petitioner had hidden the said liquor in the orchard.
4. The learned counsel for the petitioner has submitted that the entire allegation is false and fabricated and nothing was recovered from his conscious possession. He was arrested on the
Patna High Court CR. MISC. No.65519 of 2024(2) dt.24-09-2024 2/2 basis of suspicion. The petitioner is in custody since 28.06.2024 having clean antecedents.
5. Considering the above facts and circumstances, especially the clean antecedents, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II-cum-Special Judge, Excise, Madhubani in connection with Sadar Excise P.S.Case No. 181 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
