The petitioner has filed the instant application for grant of regular bail in connection with Suryapur P.S. Case No. 161 of 2020 registered under sections 302, 201 and 34 of the Indian Penal Code.
The prosecution case in short, informant alleges that one Anil Singh with the help of this petitioner(brother of the co-accused) and other accused persons, committed murder of his own daughter with intent to disappear the evidence, they were burning the dead body in Baghar towards north of village.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.65470 of 2022(2) dt.25-02-2023 2/3 petitioner is innocent and has committed no offence due to dirty politics. He has falsely been implicated in this case. In fact, the specific allegation of murder is against the brother of the petitioner namely Anil Singh who is the father of the deceased. He further submits that there is no eyewitness of the alleged occurrence. Only on the basis of suspicion, the petitioner has been dragged in this case. During investigation, nothing cogent material has come against the petitioner. He has no relation with the co-accused Anil Singh and he lives separately from him. Similarly situated other co-accused has already been granted bail by the different co-ordinate Bench of this Court vide order dated 23.02.2022. in Cr. Misc. No. 34540 of 2021. The petitioner is languishing in judicial custody since 25.06.2022.
The application for bail is vehemently opposed by learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Suryapur P.S. Case No. 161 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)
