JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13.09.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Trial court has reported that out of eight proposed prosecution witnesses, six prosecution witnesses have already been examined and trial of the petitioner is pending only for examination of Investigating officer. Trial court has further reported that to procure the attendance of the aforesaid I.O, letters have already been sent upto IG, Muzaffarpur but all went in vain.
Since there is specific allegation against the petitioner that he gave repeated blow causing fatal injury to the deceased and prayer for bail of the petitioner had earlier been rejected on merit, again, I am not inclined to release
Patna High Court Cr.Misc. No.32969 of 2017 (3) dt.13-09-2017 the petitioner on bail and hence, his prayer for bail in connection with Session trial no. 194/2015 arising out of Madhaura P.S. Case no. 325/2014 pending in the court of Addl. Sessions Judge II, Saran at Chapra stands rejected. However, learned trial court is directed to conclude the trial of the petitioner within four months from the date of receipt/production of a copy of this order, failing which petitioner may renew his payer for bail before the trial court itself.
Let copy of this order be sent to Superintendent of Police, Saran at Chapra as well as IG, Muzaffarpur zone with direction to them to ensure the presence of the I.O before the concerned court within one month from the date of receipt/production of a copy of this order, failing which matter shall be viewed seriously.
