Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, who is languishing in custody, seeks bail in a case registered under sections 420, 467, 468 and 471 of the Indian Penal Code, is solitary named accused in this case with allegation of realizing substantial amount from the informant in the garb of installation of a mobile tower against good return but in spite of investment nothing could be done. Any how, he could be located roughly after five years and, thereafter, intercepted and apprehended, produced before the police.

Patna High Court Cr.Misc. No.48297 of 2014 (2) dt.20-02-2015 2/2 Submission is of false implication with ulterior motive. Further he carries no criminal antecedent. If it is so, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Gaya in connection with Chandauti P.S. Case No.193 of 2014, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
