2. The petitioner apprehends his arrest in connection with Nalanda Cyber P.S Case No. 111 of 2023 registered under sections 420, 406, 120B)/34 IPC and Sections 66(C) and 66(D) of the Information and Technology Act lodged on 26.10.2023 by the informant, Kumar Upendra Sinha.
3. As per the prosecution story, the informant alleged that an unknown person called him on his mobile and resulted into siphoning of Rs. 56,000/- by seven transactions which led to the FIR.
4. Learned counsel for the petitioner submits that the petitioner does not have criminal antecedent and he is a young boy and also is ready to pay Rs. 56,000/- to the informant. Further, the submission is that without accepting the allegation

No.62611 of 2025(4) dt.18-12-2025 2/3 and/or the outcome of the present petition, the petitioner would like to deposit Rs. 56,000/- through demand draft directly to the informant to be paid in installment in the following manner:- (i) Rs. 20,000/- shall be paid to the informant by the petitioner at the time of execution of bail bond.
(ii) Rs. 6,000/- each (Total Rs. 36,000/-) in six installments in next six months to the informant by tenth of every month till June, 2026. (iii) failure to pay, the informant can take steps for cancellation of bail bond.
5. Learned APP for the State, on the other hand, opposes the prayer for anticipatory bail.
6. Considering the submissions of the parties and the fact that petitioner is ready to pay Rs. 56,000/- to the informant in the aforesaid manner, in that background, this Court is inclined to grant anticipatory bail to the petitioner.
7. Let the petitioner in the event of arrest or surrender within a period of four weeks from the date of receipt of the order, shall be released on anticipatory bail subject to payment of Rs. 56,000/- in the aforesaid manner on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda Cyber
Patna High Court CR. MISC. No.62611 of 2025(4) dt.18-12-2025 3/3 P.S Case No. 111 of 2024 to the following conditions:- (i) one of the bailor should be the family members/relatives of the petitioner, who shall provide official document to show his bona fide.
(ii) the petitioner shall appear on each and every date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the trial court itself;
(iii) the petitioner shall in no way try to induce orpromise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds. (iv) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of the bail bonds. (Rajiv Roy, J) Vikash/- U T
