2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 27.02.2024 passed in Cr. Misc. No. 75163 of 2023.

3. The petitioner seeks regular bail in a case registered for the offence under Sections 399, 402, 413, 414, 420, 467, 468, 472, of the Indian Penal Code and under Section 25(1-b)a, 26(ii), 35 of the Arms Act.

4. The petitioner was caught with a country made pistol while planning a loot. He is accused in 7 more similar and serious cases. He is in custody since 17.07.2023.

5. The Trial Court report has come that not even a single witness has been examined.

6. The learned counsel for the petitioner on instruction submits that till date no witness has been examined.

7. Considering the period of custody and the stage of trial, this application is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.D.J.-IV, Madhubani/concerned Court below in connection with Jaynagar P.S. Case No. 307 of 2023 subject to condition that:- (i). The petitioner will mark his attendance at the Khajauli Police Station, Madhubani on every Sunday of each month and at the Jaynagar Police Station, Madhubani on every Wednesday of each month. Any default in appearance at the both Police Stations would result in cancellation of bail bond of the petitioner.
