The petitioner in the present case is seeking regular bail in connection with Yogapatti (Sanichari) P.S. Case No. 127 of 2017, registered for offences alleged under Sections 413 and 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is of recovery of a motorcycle from his possession. It is submitted that the motorcycle bearing no. BR 22M 5946, which is said to have been recovered from his possession, belongs to his father-in-law, namely, Bhabhikshan Yadav. The petitioner was not in possession of the paper on the
Patna High Court Cr.Misc. No.32308 of 2017 (2) dt.20-07-2017 2/2 spot, therefore, it could not be produced. Learned counsel further submits that although there is an allegation that at the instance of this petitioner a motorcycle was recovered from one Nand Lal Choudhary, however, the said Nand Lal Choudhary has been granted regular bail by a co-ordinate bench of this Court in Cr. Misc. No. 27953/2017. Learned counsel submits that the petitioner has no criminal antecedent and is in custody since 28.04.2017. In the facts and circumstances stated hereinabove, let the petitioner, namely, Dinesh Yadav be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Bettiah, District - West Champaran in connection with Yogapatti (Sanichari) P.S.
