Mr.Ram Sumiran Rai ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-01-2025 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered under Sections 304(B), 201/34 of the Indian Penal Code. Allegation against the accused persons including the petitioners is of torturing and causing death of the victim due to non-fulfillment of demand of dowry.

It has been submitted on behalf of the petitioners that the petitioner Nos. 1 to 4 are father-in-law, mother-in-law, Devar and Bhainsur of the deceased whereas petitioner Nos. 5 & 6 are villagers

Patna High Court CR. MISC. No.74487 of 2024(3) dt.17-01-2025 2/2 of husband of the deceased. Initially, the case was registered for the offence under Section 304(B) of the Indian Penal Code and later on, Section-302 of the Indian Penal Code was also added. It has also been submitted that exactly on similar allegation, the co-accused, Pradeep Rai has been granted regular bail by this court in Cr. Misc. No. 65949 of 2024.

Learned APP has opposed the prayer for anticipatory bail. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, Vaishali at Hajipur in connection with Raghopur P.S. Case No. 147 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
