JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Both petitions arise out of Warsaliganj P.S. Case No. 14 of 2017 registered for the offence under Sections-420, 467,471, 120(B) of the Indian Penal Code as well as Section-10 of Bihar Examination Control Act and accordingly, they are being heard and disposed of by this common order.

Patna High Court Cr.Misc. No.26711 of 2017 (4) dt.19-07-2017 Heard learned counsel for the petitioners and the State. It has been submitted on behalf of petitioners that except mobile phone, ATM cards etc no other incriminating articles were recovered from possession of the petitioners, which may show that they were preparing to commit illegal act in helping the examinees appearing in BSSC. It has further been submitted that co-accused with similar allegation have already been granted privilege of bail by this court vide order dated 30-062017 passed in Cr. Misc. No. 24210 of 2017 and analogous cases. These petitioners are in custody since 06-02-2017. In such circumstances, prayer for bail is allowed and it is ordered that the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs.

10,000/- (ten thousand) with two sureties of the like amount each in connection with Warsaliganj P.S. Case No. 14 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate-II, Nawada subject to condition that both the bailors should be relatives of the petitioners.
