The petitioner apprehends his arrest in connection with Bishambharpur P.S. Case no. 66 of 2019, registered under Sections 341, 323, 324, 307, 379 and 435/34 of the Indian Penal Code.

The accusation is that on 30.06.2019 at about 3.00 P.M. Manju Devi, Gotni of informant, had gone to her Bathan then saw that vegetable plant was covered then she made inquiry whereupon, petitioner Raj Kumar Giri came there and started to cause assault her. Thereafter, informant went there then Satish Giri, Awdhesh Giri and Ramawati Giri having armed with Lathi, Farsa and Dab came there and started assaulting her. At that time, they also snatched her golden

Learned counsel for the petitioner submits that, in fact, occurrence of Marpit took place in between the parties in which petitioner's side also sustained injury regarding which Bishamgharpur P.S. Case No. 67 of 2019 was instituted on 03.07.2019 against the informant and others of the present case. Moreover, the injuries as found on the person of informant and her Gotati are simple in nature. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-X, Gopalganj in connection with Bishambharpur P.S. Case No. 66 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
