The petitioner seeks bail in connection with Samastipur (Mufassil) P.S. Case no. 258 of 2015 registered under sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

Regard being had to the fact that the petitioner is named in the first information report with allegation that immediately after the deceased was killed, he along with others came out from the shop of the deceased being armed with Pistol and in the post mortem examination one wound of entry and exit was found on the dead body of the deceased coupled with the fact

Patna High Court Cr.Misc. No.52392 of 2015 (4) dt.30-01-2016 that the petitioner is a habitual offender, who has been made accused in at least four other cases, I am not inclined to grant him bail.

Accordingly, the prayer for bail of the petitioner is rejected.
