The learned Counsel for the petitioners submits that petitioners no. 2 and 3 have been arrested as such their applications has become infructuous.

Petitioners no. 1 and 4 are apprehending their arrest in a case registered for the offences punishable under sections 341, 323, 504/34 of the India Penal Code. It is alleged that the accused persons came to the door to the informant and called them by their caste name and witch. Accused persons also spit on the face of the informant, drag the informants by catching

Patna High Court Cr.Misc. No.53785 of 2015 (2) dt.26-11-2015 2/2 their hair and also assaulted them. When the husband came to rescue, he was also assaulted. It is also alleged that the accused persons used to throw garbage in front of house of the informant and on protest being made; the accused persons abused and gave threat. It is submitted by the learned. Counsel for the petitioners that the case filed by the petitioners is at earlier point of time. It is a case for consideration of regular bail of petitioners 1 and 4, if they surrender before the learned court below within a period of six weeks from today in connection with Daraoli P.S. Case No. 153 of 2015.

With the aforesaid observation, this application is disposed of.
