The petitioner seeks bail in Udwantnagar P.S. Case No. 354 of 2014, registered for the offence under Section 302, 34 of the Indian Penal Code.

It is submitted on behalf of petitioner that similarly situated co-accused Radha Mohan Singh, who is also said to have taken away the husband of the informant from the house, has already been granted bail by a coordinate Bench of this Court, vide order dated 12.01.2018 passed in Cr.Misc. No. 983 of 2018 {Annexure 3 (I)}. Only suspicion has been raised against this petitioner and no specific overt act has been alleged against this petitioner. It is further submitted that though, petitioner has got criminal antecedent and he is accused in two more cases, but in both the cases, he is on bail. Petitioner is in custody since 17.11.2021.

Patna High Court CR. MISC. No.71639 of 2021(2) dt.08-03-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara / concerned court in connection with Udwantnagar P.S. Case No. 354 of 2014.
