JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sitamarhi Mahila P. S. Case No. 40/2016 registered for offences punishable under Sections 498 (A), 341, 323, 324, 342, 506, and 504/34 of the Indian Penal Code.

The allegation upon the petitioner is of torturing the Opposite party No.2, Rinku Kumari, wife of the petitioner. Submission is that the allegation against the petitioner is false and is only with a view to put pressure to grab the property of the petitioner. Even after institution of first F. I. R., Opposite Party No.2 lodged one another F.I.R. being Sitamarhi P. S. Case No. 442 of 2016 for which the petitioner has filed one I.A. petition No. 560/2016 before the learned Chief Judicial Magistrate,

Patna High Court Cr.Misc. No.53247 of 2016 (3) dt.16-02-2017 2/2 Sitmarhi. Learned counsel for the petitioner submits that the petitioner is ready to live with his wife with full dignity and the petitioner is in custody since 23.10.2016.

However, learned A.P.P. for the State opposed the prayer for bail.

Having considered the facts, let the above named petitioner, Sujit Kumar @ Sujit Kumar Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi Mahila P.S.
