2. The petitioner apprehends his arrest in connection with Bakhari P.S. Case No. 293 of 2023 registered under Sections 420, 406 and 120B of the Indian Penal Code.
3. As per prosecution case, petitioner, who was field worker at the relevant time, embezzled Rs.7,86,773/- which was collected from the customers.

Learned counsel for the petitioner submits that from perusal of the F.I.R., it is apparent that in the first part of the allegation portion, it is alleged that Rs. 7,86,773/- was misappropriated by the petitioner, however in concluding part the embezzled amount, so far it relates to petitioner, has been reduced to Rs. 5,92,711/-, which is said to have been embezzled
Patna High Court CR. MISC. No.63812 of 2024(3) dt.17-01-2025 2/3 and not deposited by the petitioner in the account of the company. However, without admitting the allegation made in the F.I.R., the petitioner is ready to deposit Rs. 5,92,711/- (Rupees five lacs ninety two thousand seven hundred eleven) in three installments in the Nazarat of concerned Civil Court, for which, learned counsel for the informant does not oppose.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Bakhari P.S. Case No. 293 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further following conditions: "(A) At the time of furnishing bail-bond, the petitioner shall deposit Rs. 2,00,000/- (Two lacs) in the Nazarat of concerned Civil Court and receipt of the same shall be furnished (B) Rest amount i.e. Rs. 3,92,711/- (Three Lacs ninety two thousand seven hundred eleven) shall be deposited in the Nazarat of concerned Civil Court in three installments within a period of six months from the date of furnishing bail-bond. (C) The aforesaid payment shall be subject to
Patna High Court CR. MISC. No.63812 of 2024(3) dt.17-01-2025 3/3 final outcome of the case.
(D) If petitioner fails to comply the direction of this Court, the learned Court below would be at liberty to cancel the bail-bond of the petitioner."
6. This order has been passed, without going into the merit of the case, only for the purpose of considering the prayer for anticipatory bail of petitioner.
