02. 13.07.2017 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in a case registered for offences under 30(a) of the Prohibition of Bihar Excise (Amendment) Act, 2016.
It is contended that, as per allegation, 44 litres of country-made liquor were recovered from the house of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 30.03.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten
Patna High Court Cr.Misc. No.31813 of 2017 (2) dt.13-07-2017 Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-cum-Special Judge, Excise Act, Aurangabad in connection with Tandwa P.S. Case No. 09 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
