The petitioners apprehend their arrest in connection with K. Nagar (Maranga) P.S. Case No. 543 of 2015 registered under Sections 341, 323, 307, 379 and 504/34 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners submits that there is general and omnibus allegation against the petitioners. The informant is own nephew of the petitioner no.3. The occurrence took place due to land dispute between both the family members.
Patna High Court Cr.Misc. No.55494 of 2016 (7) dt.21-03-2017 2/2 Learned A.P.P. appearing on behalf of the State vehemently opposed the prayer of the petitioner no. 4 Binod Singh, against whom there is direct allegation of assault by means of axe causing grievous injury.
Having considered the facts and circumstances of the case, prayer of the petitioner no. 4 Binod Singh is rejected and at the same time, prayer of rest of the petitioners is allowed. Let the above named petitioner nos. 1 to 3 and 5 be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the S.D.J.M., Purnea in connection with K. Nagar (Maranga) P.S. Case No. 543 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
