The petitioner seeks bail in Darauli P.S. case No. 107 of 2013 under Section 366A, 384/34 of the Indian Penal Code. The informant filed a complaint case alleging therein that Vivek Sahni and one unknown persons kidnapped her daughter, Raj Nandini Kumari.

The learned counsel for the petitioner submits that during the course of investigation the victim appeared and made her statement under Section 164 of the Cr. P. C. She disclosed that Vivek Sahni kidnapped her. It is submitted that petitioner has nothing to do with Vivek Sahni and the victim. The victim solemnized marriage with Vivek Sahni and Vivek Sahni has already been acquitted. The petitioner is in jail since 28.02.2017. It

Patna High Court Cr.Misc. No.20456 of 2017 (4) dt.10-07-2017 2/2 is submitted that charge sheet is submitted against the petitioner in the month of March, 2017.

Considering the facts that the victim solemnized marriage with Vivek Sahni and the petitioner has already remained in jail for about five months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Siwan in Darauli P.S.
