====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with S.K. Puri P.S. Case No. 136 of 2017, registered for the offence punishable under Section 414 of the Indian Penal Code. The case of the prosecution is that the informant of Gandhi Maidan P.S. Case No. 260 of 2017 had gone to Mona Cinema on 9.5.2017 at about 9.00 p.m. for watching movies and from where his motor cycle was stolen. Subsequently, the police is said to have recovered the motor cycle from possession of Md. Shanu Alam and Md. Arman @ Bhobha @ Chhotu. It has been further alleged that one person had got on a motor cycle and fled away and the name of the said person was disclosed to be Kallu @ Vikash Kumar i.e. the petitioner herein.

No.37683 of 2017 (2) dt.10-08-2017 2/2 The learned counsel for the petitioner submits that the petitioner is innocent, has got no criminal history and no recovery has been made from his possession. It is further submitted that the petitioner has been arrested merely on suspicion without there being any material to be connected with the alleged offence and has been languishing in jail since 25.6.2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned J.M. Ist Class, Patna in connection with S.K. Puri P.S. Case No. 136 of 2017.
