JUSTICE SUDHIR SINGH ORAL ORDER 07-05-2015 The petitioner is apprehending his arrest in connection with Lakhisarai P.S. Case No. 411 of 2014 for the offence under Sections 467, 468, 469, 420 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State.

The prosecution story, in brief, is that the accused Rani Kumari had taken loan amount of Rs. 3,00,000/- on 16.02.2012 from the U.C.O. Bank Brach, Lakhisarai on the basis of forged and fabricated documents in which one Subodh Kumar was the guarantor, Vijay Singh was the identifier. The informant being the Branch Manager inquired into the matter and found that the guarantor and lonee were the fake persons. It is submitted on behalf of the petitioner that the petitioner is not named in the First Information Report, nor there is any specific allegation against the petitioner. On behalf of the State, it has been submitted that the fake loan was made by the petitioner.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 411 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

It is further directed that the petitioner shall deposit an amount of Rs. 50,000/- before the learned court below and the same shall be subject to the final disposal of the case.
