Learned counsel for the petitioner is permitted to remove the defect/(s), as pointed out by the office, if any, within a period of four weeks from today.
Petitioner is apprehending his arrest in Brahampur P.S. Case No. 412 of 2021 registered for the offences punishable under Sections 341, 323, 447, 324, 307/34 of the Indian Penal Code.
Allegation against the petitioner is that he is the order giver to assault the informant and also assaulted the informant. Learned counsel for the petitioner submits that both the parties are gotiya and co-sharer. There is case and counter case between the parties due to land dispute and both the parties
Patna High Court CR. MISC. No.71328 of 2021(2) dt.08-06-2022 2/2 indulged in free fighting, received injury and doctor opined the injuries are simple in nature. He further submits that petitioner is 60 year old person having no criminal antecedent. Learned APP for the State has opposed the anticipatory bail of the petitioner.
Considering the aforesaid facts and circumstances of the case, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Brahampur P.S.
