The petitioner seeks bail in a case registered under Sections 341, 448, 307, 504, 506/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons including the petitioner came at the door of the informant and on instigation of other accused, accused Sandeep Kumar opened fire from his pistol aiming at the informant, who was withdrawn back by his nephew and any how saved and informant fled into his house to save his life and bolted down the doors, but petitioner opened indiscriminate firing at the doors of the informant to create terror.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.57436 of 2019(2) dt.11-09-2019 2/2 the petitioner is in custody since 19.07.2019. There is no allegation of tampering of witnesses alleged against the petitioner. None is said to have been injured in course of occurrence. Due to previous enmity, the present case has been filed against the petitioner and others. No offence under Section 307 of the I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate VIII, Bhojpur at Ara in connection with Ayar P.S. case No.55 of 2019.
