JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302, 201, 120B /34 of the Indian Penal Code.

The prosecution case is that the dead body of the husband of the informant was recovered from the railway track, leading to registration of FIR against unknown. During investigation, the suspicion was raised against co-accused Lala Ravidas that he had illicit relation with the informant which was protested by the victim, as a result, the victim was eliminated by Lala Ravidas in connivance with the informant. Second theory surfaced, during investigation, was that this petitioner had illicit relationship with the mother of the victim and the petitioner and mother of the victim used to use the house of the victim against his

It is submitted by learned counsel for the petitioner that only on suspicion, the accusation has been levelled and mother of the victim, Shanti Devi, has been granted anticipatory bail vide Criminal Miscellaneous No.33243 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Patna in connection with GRP Mokama P.S. Case No.18 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
