In this case, the petitioner is seeking bail in connection with Amas P.S. Case No. 184 of 2012 registered for offences under sections 147, 148, 149, 447, 341, 323, 324, 328, 326, 307, 302 and 504 of the Indian Penal Code. There is a dispute which took place in between the family of the petitioner and the informant in connection with keeping a wooden slab near the hand pump. The situation turned hostile. Allegation has been made specifically against the petitioner to have given Garasa on the parietal region of the victim who ultimately succumbed to the injury.
The counsel for the petitioner submits, there is only general and omnibus allegation which has been made against other
Patna High Court Cr.Misc. No.45390 of 2013 (3) dt.24-12-2013 2/2 accused persons, and was not specifically mentioned against the petitioner and the petitioner side have also received injury in that incident. He further submits that other persons, who have only general allegation, have been granted bail by this Court. As in paragraphs 10-11 of the case diary specifically mentioned the name of the petitioner being involved in causing injury on the head of the victim, this Court is not inclined to grant bail to the petitioner. Accordingly, this petition is rejected. However, the court below is directed to expedite the trial. (Shivaji Pandey, J) Mahesh/-
