The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 354, 504, 506 of the Indian Penal Code and section 8 of the POCSO Act.

As per the prosecution case, this petitioner tried to molest the grand-daughter (minor) of the brother of informant. It is submitted that petitioner has been falsely implicated in this case due to dirty village politics. After investigation the police submitted chargesheet under Section 504 of the Indian Penal Code. Learned court below differing with the same took cognizance under Section 354, 323, 341, 504 and 506 of the Indian Penal Code and section 8 of the POCSO

Patna High Court CR. MISC. No.62954 of 2022(2) dt.17-03-2023 2/2 Act. Moreover, the matter has been compromised between the parties and a compromise petition has been filed before the learned court below vide Annexure-4 to this petition. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VII-cumSpecial Judge, POCSO Act, East Champaran in connection with Phenhara P.S. Case No. 75 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
