JUSTICE SANJAY PRIYA ORAL ORDER 10-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 420, 467, 468, 120(B) of the Indian Penal Code and Section 66 of I.T. Act.

It is alleged that S.H.O. Katrisarai got information on mobile by one Niranjan Gupta holder of account No. 9873506259 that accused Suraj Kumar holder of account No.

2351000100180720 had withdrawn Rs.9,800/- from his account through Paytm and cheated him. The informant on enquiry learnt that the aforesaid account had been closed on the basis of application filed by Niranjan Gupta and on verification of account of accused Suraj Gupta, it appears that he had opened account on pasting photographs of another person and the

There is mere allegation against the petitioner that he was identifier of the account of Suraj Kumar. There is no other specific allegation against the petitioner in the written report. It has been mentioned that the amount has been withdrawn by the co-accused Suraj Kumar. The petitioner is in custody since 3.10.2016. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Giriyak (Katrisarai) P.S. Case No. 285 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
