Munger on 19.11.2021
Patna High Court CWJC No.20980 of 2021(3) dt.16-02-2022 2/3 as contained in Annexure-1 of this writ petition be quashed.
(ii) That the Financial Bid of the petitioner be directed to be processed.
(iii) That during the pendency of the writ petition, respondents be restrained from finalizing the contract and executing agreement of acceptance in favour of any Bidder.
(iv) That if, it is found that the process of selection of contract has been finalized, the entire process of selection of contract in pursuant to the NIT No. 2724 dated 24.08.2021 be quashed and direction be issued for re-tendering of the contract afresh.
(v) That alternatively the respondents be directed to dispose of the Appeal filed by this Petitioner with speaking order within stipulated frame of time.
(vi) That any other relief/reliefs be granted to the petitioner as may be deemed fit and proper in the facts and circumstances in the case."
After the mater was heard for some time, finding the Court not in favour of the submissions made by the learned counsel for the petitioner, learned counsel for the petitioner, under instructions, states that the petitioner shall be content if the petitioner is permitted to withdraw the present petition, with liberty to initiate appropriate proceedings before the appropriate forum and to take recourse to such other alternate remedies
Patna High Court CWJC No.20980 of 2021(3) dt.16-02-2022 3/3 which are equally efficacious in law.
Prayer allowed.
The petition is disposed of as withdrawn with the liberty aforesaid.
Interlocutory application(s), if any, shall also stand disposed of.
