The petitioner seeks bail in connection with Khaira P.S. Case no. 5 of 2017 registered for the offence punishable under Sections 447, 448, 323, 324, 307, 380, 379 and 504/34 of the Indian Penal Code and 3/4 of the Explosive Substance Act. The informant has alleged that on 12.01.2017 when she came out after opening the door of her house to meet the call of nature, this petitioner hurled bomb on her, but did not cause injury. The other co-accuseds namely, Murari Singh and Banti Singh also hurled bomb which caused injury to the informant and her two sons. They further entered into the house and took away a suitcase containing Rs. 50,000/-, gold chain and other articles.

Patna High Court Cr.Misc. No.33786 of 2017 (2) dt.20-07-2017 The learned counsel for the petitioner submits that co-accused Banti Singh, who allegedly hurled bomb and caused injury to the informant and her two sons have been allowed bail vide order dated 05.07.2017 passed in Cr. Misc. no. 26010 of 2017 by one of the co-ordinate Bench of this Court. The petitioner is in custody since 03.03.2017 having clean antecedent and a land dispute is going on between the parties. Learned APP, on the other hand, opposed the submissions.

Considering the case of this petitioner on similar footing, his prayer of bail is allowed. The above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case no. 5 of 2017. (Sanjay Kumar, J) rohit/- U T
