The petitioner in this case is seeking regular bail in connection with Darihat P.S. Case No. 111 of 2021 registered for the offence punishable under Sections 302/34 of the Indian Penal Code. He has no criminal antecedent and is in custody since 15.07.2021.

Learned counsel for the petitioner submits that as per the prosecution story, the petitioner is alleged to have assaulted the elder son of the informant by sword causing injury on neck, mouth, ear, head and chest. As a result of which he fell down and became unconscious. The other accused persons also assaulted informant's husband and the younger son of the

Learned counsel submits that the petitioner is innocent and has not committed any offence. It is further submitted that petitioner's father and the husband of the informant are agnates and the dispute arose due to land dispute. Learned APP for the State has opposed the prayer for bail of the petitioner.

Having regard to the seriousness of the allegations, the death of three persons in the alleged occurrence and there being a direct allegation against the petitioner that he had assaulted the elder son of the informant by means of sword due to which he fell down and became unconscious, this Court is not inclined to release the petitioner on bail. The prayer for bail of the petitioner is refused.
