JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-04-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 401/34 of the Indian Penal Code and u/s 8/20 of NDPS Act.
As per the prosecution case, in course of special checking of platform of Muzaffarpur Railway station two persons were found in suspicious condition. On chase this petitioner was caught who disclosed that he is indulged in theft at platform after administering sedative tablets to the passengers. Ten tablets of Proline 2 mg, Rs. 50 cash and a piece of blade have been recovered from his possession. Learned counsel appearing for the petitioner submits
Patna High Court CR. MISC. No.71333 of 2021(3) dt.26-04-2022 2/2 that petitioner is innocent and has falsely been implicated in the case only on suspicion. Recovered narcotic substance is less than small quantity. Petitioner is in custody since 24.08.2021 and investigation in this case is complete.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-V, Muzaffarpur in Muzaffarpur Rail PS case No.106/2021.
