JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Nine prosecution witnesses have already been examined as per report of learned trial court.

No doubt, earlier trial court was directed by this court to conclude the trial of the petitioner within six months but trial could not be concluded within the above stated period. However, report of learned trial court reflects that witnesses are being produced before the court under police security and trial court has sought two months' more time for disposal of Sessions trial no. 859/2014 arising out of Dholbajja (Kadwa) P.S. Case no. 11/2014.

Considering the above stated factual aspect of the trial as well as submissions of the parties, again, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection

Patna High Court Cr.Misc. No.31955 of 2017 (3) dt.16-08-2017 with Session trial no. 859/2014 arising out of Dholbajja (Kadwa) P.S. Case no. 11/2014 pending in the court of Addl. Sessions Judge I, Naugachia stands rejected.

However, learned trial court must expedite the trial of the petitioner and try to conclude the same as early as possible, preferably within four months from the date of receipt/production of a copy of this order.
