The petitioner seeks regular bail in connection with Parasbigha P.S. Case No. 20 of 2021 registered for the offence under Sections 363, 366(A)/34 of the Indian Penal Code. Prosecution case relates to abduction of the victim daughter of the informant by the accused petitioner along with co-accused persons for the purpose of marriage. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is the married sister of the main accused due to which she has falsely been implicated in this present case. As per the impugned order, the victim was recovered and stated in her

Patna High Court CR. MISC. No.59200 of 2022(3) dt.07-02-2023 2/2 statement recorded under section 164 of Cr.P.C. that she solemnized marriage with brother of the petitioner namely, Sagar Kumar with her own sweet will. The petitioner has got no criminal antecedent and has no concern with the alleged offence. It is further submitted that the petitioner is languishing in judicial custody since 27.8.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Parasbigha P.S. Case No. 20 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO), Jehanabad.
