Case No. 137 of 2017 registered for the offence(s) under section(s) 30/30(A) of the Bihar Excise (Amendment) Act, Allegation is of recovery of wine.

Submission of the learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner rather it has been recovered from a public place and the petitioner is in custody for three months. Further submission is that except this case the petitioner has also been implicated in two more cases of similar nature but nothing has been recovered from his possession in these cases.

Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.32899 of 2017 (2) dt.14-07-2017 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, the Trial Court is directed to expedite the trial and conclude the same within a period of six months. If the trial is not concluded by the aforesaid period, the petitioner will have liberty to renew his prayer for bail.

With the above observation and direction, this application is dismissed.
