1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 392 of the Indian Penal Code.

3. As per the prosecution case, it is a case of loot of ornaments and other articles from the house of the informant by 3-4 unknown persons on the point of fire-arm.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case and his name has transpired on the basis of confessional statement of co-accused Raja Nut. It is further submitted by learned counsel for the petitioner that informant has also supported the case of prosecution in her statement recorded at

Patna High Court CR. MISC. No.65134 of 2023(2) dt.12-10-2023 2/2 para no.17 of the case diary. Petitioner is in judicial custody since 03.07.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra in connection with Marhowrah (Madhaura) P.S. Case No. 323 of 2016.
