====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 24-09-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks regular bail in a case registered under Sections 30(a), 32 of Bihar Prohibition and Excise Act and Sections 318(4) & 317(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, on the basis of secret information, police stopped one Tata Ace Magic Pickup bearing Reg. No. BR01-GN-2647 loaded with illicit liquor, which was driven by co-accused Rajesh Kumar, who after seeing the police, tried to escape away but he was apprehended on chase. On enquiry, he told that the said illicit liquor belongs to the persons, who are coming behind in a Scorpio vehicle bearing Reg. No. BR33-PA-1642. On the basis of his disclosure, the said

No.61050 of 2025(2) dt.24-09-2025 2/3 Scorpio vehicle was stopped in which this petitioner along with three accused persons was sitting, and on seeing the police party, they tried to flee away from the spot but they were apprehended on chase. On search, total 463.32 litres illicit liquor was recovered from the aforesaid vehicles.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Further submission is that petitioner is neither the owner nor the driver of the seized vehicles. On the alleged date of occurrence, petitioner had taken the Scorpio vehicle on rent to visit Deoghar and petitioner had no knowledge about the illicit liquor which was kept on the vehicle. Nothing has been recovered from the conscious possession of the petitioner. Similarly situated co-accused Aman Kumar has already been granted regular bail by this Court vide order dated 21.08.2025 passed in Cr. Misc. No. 56862 of 2025. It is submitted that petitioner has clean antecedent and he is in custody since 06.07.2025. There is no chance of absconding of petitioner or tampering with the evidence. Petitioner undertakes to cooperate in the trial.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case, the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-II, Munger in connection with Sangrampur P.S. Case No.113 of 2025.
