JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 31.03.2015 Supplementary affidavit is filed on behalf of the petitioner. Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner is in jail custody since 11.7.2014 in a case registered under section 307 and other allied sections of the IPC and 27 of the Arms Act.

The accusation against the petitioner is that he along with co-accused Rahul Singh and Rohan Singh took away one Navin Kumar Singh son of Amir Singh but from perusal of the case diary, I find that the Investigating officer did not take any pain to trace out the aforesaid Navin Kumar Singh and without his recovery and without taking his statement, charge sheet was submitted against the petitioner for the offences under sections 147, 149, 448, 323, 324, 325, 307 and 504 of the IPC and 27 of the Arms Act.

Moreover, co-accused Sanjeev Singh and Rohan Kumar

Patna High Court Cr.Misc. No.50405 of 2014 (4) dt.31-03-2015 Singh have already been granted privilege of bail by a coordinate bench of this court vide order dated 18.07.2014 passed in Cr. Misc. no.20365/2014.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Bajpatti P.S. Case no. 31/2014.
